✏️ Revisions

Every project includes an unlimited amount of revisions before project acceptance and launch or delivery of the final product. Revisions are based on the original project scope and brief. Changes that expand scope (adding pages, new features, restructuring the sitemap) are quoted separately as a change order.
All revised specifications submitted after contract signature will be considered additional for all contractual purposes. Island Sun Design LLC reserves the right to refuse project revisions after work has begun on the contract, or where technical limitations prevent their completion

Revision requests should be consolidated and submitted together — not piecemeal — to keep the project on schedule.

🗓️Refunds

Refunds for terminate website contracts will depend on the circumstances behind the termination. All acceptable causes and reason(s) for termination are outlined in the contract.

🌺Hawaii GET Tax

Island Sun Design LLC is based in Hilo, Hawaii. Per state law, Hawaii General Excise Tax of 4.712% is added to all invoices regardless of the client's location. The tax line is itemized on every invoice.

🗓️Contracts

All projects are to be done under either a one-time development contract or an ongoing web development contract. Both contracts serve as an invaluable assurance for both the client and the consultant.

All contracts will be sent through the digital signature service HelloSign.com, which allows signing parties to either sign the document digitally or draw out their signature (like writing with a mouse, it provides the blank) . There is no additional charge for this service.

🗓️Content provided by the client

All images/content provided by the client must be legal for the client to use and redistribute. It is the client’s sole responsibility to verify the copyright, licensing, intellectual property, model release, and usage rights for all provided images, media, and content. I reserve the right to refuse inclusion of any material or content that I believe to be copyrighted or text plagiarized from other websites. If you feel that your media has been used on one of my client’s sites without authorization, please contact me through the contact page immediately. I use a variety of public domain image repositories for most images, and licensed images may be acquired through various premium sources as needed.

Note that I will not copy or attempt to duplicate an existing website unless explicitly authorized by the owner of the website’s usage rights. General design styles, however, may be used as allowed.

🗓️Website Hosting

Island Sun Design LLC does not offer website hosting. All clients must provide their own website hosting, but I will generally be happy to offer recommendations for your domain and hosting needs (an additional consulting service)

🗓️ Referrals

I appreciate any referrals for web design services that can be offered, however I cannot offer any direct compensation for referrals (with the exceptions of previous arrangements or sales contractors)

🗓️ File Formats Accepted

PSD, .GIF, .JPG, .ZIP (archive), .OSD,.RTF, .DOC, .PDF, .RAR, .PNG, .GMP, .ODF. Other formats may be accepted depending on website needs.

🗓️ Delivery of Web site materials and content

Upon full completion of payment, the web site design materials will be provided to the client via either digital means (FTP, ZIP by email, etc), or posted to the intended website directory or other contractually-arranged delivery. Previews for graphics design and image editing may be watermarked prior to preview, however the final content will be in a form with the watermark removed.

🗓️ Privacy

All reasonable efforts will be made to ensure the privacy of my clients. All email is considered confidential unless otherwise noted, and I will happily sign a Non-Disclosure agreement if requested. Email archives may be stored indefinitely. Web site projects requiring HIPAA or other stringent legal privacy requirements may be refused or referred respectively.

🗓️ Plagiarism and Intellectual Property Limitations

I do not knowingly plagiarize text from or fully copy websites without permission. While general layouts or aesthetic styles can be used (unless protected by applicable trademark or otherwise prohitibited) , copying a website in it’s entirety is not only against the law – it’s just not right. The customer bears all responsibility for verifying the usage rights of any copyrighted or sourced content. Note – I will happily duplicate or work with websites/content owned by my clients (or with the appropriate permission).

🗓️ Project Timelines

Estimated timelines are provided at the start of each project and depend heavily on client responsiveness. Delays in receiving content, feedback, approvals, or payment will extend the timeline accordingly. Several active projects may be in development simultaneously.

📦 Content Responsibility

Clients are responsible for providing all written content, photos, logos, and brand assets needed for their project. If content is not provided within 30 days of project kickoff, the project may be rescheduled to accommodate other work. Copywriting and photography services are available as add-ons.

🔐 Ownership & Intellectual Property

Upon receipt of final payment, the client owns the final delivered website design, content, and intellectual property rights (where the involved technologies or platform(s) allows. See individual licenses for details) . Island Sun Design retains the right to display the completed work in the portfolio unless otherwise agreed in writing. Any work producted by Island Sun Design remains the intellectual property of Island Sun Design until final payment is received, at which point it is automatically released to the client\'s ownership

🤝 Confidentiality

All project information shared by clients — business plans, customer data, strategies — is treated as confidential and will not be shared with third parties. Ryan does not sell or rent client information. A mutual NDA can be signed on request.

❌ Cancellation

Either party may cancel a project with 7 days written notice. If cancelled by the client after work has begun, the deposit is non-refundable and any completed work product will be delivered as-is. If cancelled by Island Sun Design, the client will receive a full refund of any amounts paid for work not yet delivered.

🌐 Third-Party Services

Island Sun Design may recommend or integrate third-party services (hosting providers, email platforms, payment processors, plugin developers). Ryan cannot be held responsible for the uptime, pricing changes, or policy changes of these third-party providers.

📋 Governing Law

These policies are governed by the laws of the State of Hawaii. Any disputes will be handled in Hilo, Hawaii. By engaging Island Sun Design's services, you agree to these terms.
